Terms of Use

These Terms of Use ("Terms") are an agreement between you and Mongo Technologies LLC, a Wyoming limited liability company ("Striped," "we," "us" or "our"). They cover:

  • the Striped app for iPhone and Apple Watch, including its Lock Screen Live Activity (the "App");
  • the Striped account, backup and Striped Lab services the App connects to;
  • the website at stripedgolfapp.com.

Together, these are the "Service." Our Privacy Policy explains how we handle your information and forms part of these Terms. Please read Sections 7 and 8 (safety and accuracy) and Sections 18 to 21 (disclaimers, liability, indemnity and disputes) carefully.

1. Acceptance

By signing in to or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

  • You must be at least 13 years old to use Striped. If your country sets a higher minimum age for agreeing to online services or for processing your data, you must be at least that age.
  • If you are under 18, or under the age of majority where you live, a parent or legal guardian must review and agree to these Terms for you. That parent or guardian is responsible for your use of the Service and for any purchases.
  • You may not use the Service where the law prohibits it (see also Section 6.7).

3. Your account

  • Striped requires Sign in with Apple. Your Striped account is linked to your Apple Account, and your use of Sign in with Apple is also governed by Apple's terms.
  • You are responsible for activity under your account and for keeping your devices and Apple Account secure. Tell us promptly at support@stripedgolfapp.com if you believe your account has been misused.
  • Do not share your account, sign in as someone else, or create accounts by automated means.
  • You can sign out at any time. You can delete your account in the App under Profile → Account & Backup → Your data. The Privacy Policy explains what deletion erases and what it keeps.

4. Subscriptions

4.1 Purchase and billing

Some features may be offered only to Striped subscribers. The Striped subscription is sold as an auto-renewing subscription, such as monthly or yearly, through Apple's App Store. The App shows the price, billing period and included features before you buy. Payment is charged to your Apple Account when you confirm the purchase. Apple processes all payments, and its terms apply. We never receive your payment card details.

4.2 Automatic renewal

Your subscription renews automatically for the same period at the then-current price unless you turn off auto-renewal at least 24 hours before the end of the current period. Apple charges your Apple Account for the renewal within the 24 hours before the current period ends.

4.3 Managing and cancelling

To manage or cancel your subscription, go to your Apple Account settings on your device (Settings → your name → Subscriptions) or to your account settings in the App Store. Cancelling stops future renewals; you keep access until the end of the period you have already paid for. Deleting the App or deleting your Striped account does not cancel your subscription.

4.4 Free trials and offers

If we offer a free trial or introductory price, the App will show its terms before you accept it. Unless you cancel at least 24 hours before a free trial ends, the subscription starts and you are charged when the trial ends. If you buy a subscription during a free trial, any unused part of the trial is forfeited where Apple's rules provide for it.

4.5 Refunds

Apple handles all billing, so we cannot issue refunds directly. You can request one from Apple at reportaproblem.apple.com, and Apple decides under its own policies. This does not affect any rights you have under applicable consumer law.

4.6 Price changes

We may change subscription prices. Apple will notify you in advance and, where the law or Apple's rules require it, ask for your consent before a higher price applies to your subscription.

4.7 Which account a subscription unlocks

A subscription unlocks Striped for the Striped account that was signed in when you bought it. If you use another device, sign in to the same account and use Restore purchases. Unless the App says otherwise, the Striped subscription is not shared through Apple Family Sharing.

4.8 Changes to features

We may change which features are free and which require a subscription. We will not materially reduce what the Striped subscription includes during a subscription period you have already paid for, unless the law, security or a change by a platform provider such as Apple requires it.

5. License to use the App

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App, for your personal, non-commercial use, on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. The App may also be used by other accounts associated with you through Family Sharing or volume purchasing where Apple's rules permit.

The App is licensed to you, not sold. Some components are open-source software provided under their own licenses, which govern those components.

6. Terms required by Apple

If you downloaded the App from Apple's App Store or through TestFlight, the following terms also apply. Where they conflict with anything else in these Terms, they control.

6.1 Acknowledgement

These Terms are between you and Mongo Technologies LLC only, not Apple Inc. ("Apple"). Mongo Technologies LLC, not Apple, is solely responsible for the App and its content.

6.2 Scope of license

The license in Section 5 is limited to a non-transferable license to use the App on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. The exception is that other accounts associated with you through Family Sharing or volume purchasing may access and use the App.

6.3 Maintenance and support

Mongo Technologies LLC is solely responsible for providing any maintenance and support for the App, as described in these Terms or as required by law. Apple has no obligation whatsoever to provide maintenance or support for the App.

6.4 Warranty

Mongo Technologies LLC is solely responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are the sole responsibility of Mongo Technologies LLC.

6.5 Product claims

Mongo Technologies LLC, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your possession and use of it, including:

  • product liability claims;
  • any claim that the App fails to conform to an applicable legal or regulatory requirement;
  • claims arising under consumer protection, privacy or similar legislation, including in connection with the App's use of the HealthKit framework.

These Terms do not limit our liability to you beyond what applicable law permits.

6.6 Intellectual property claims

If a third party claims that the App, or your possession and use of it, infringes that third party's intellectual property rights, Mongo Technologies LLC, not Apple, is solely responsible for investigating, defending, settling and discharging that claim.

6.7 Legal compliance

You represent and warrant that:

  • you are not located in a country that is subject to a U.S. Government embargo or that the U.S. Government has designated as a "terrorist supporting" country; and
  • you are not listed on any U.S. Government list of prohibited or restricted parties.

6.9 Third-party terms

When you use the App, you must comply with any applicable third-party terms, such as your wireless data service agreement.

6.10 Third-party beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. When you accept these Terms, Apple will have the right, and will be deemed to have accepted the right, to enforce these Terms against you as a third-party beneficiary.

7. Safety

Golf is a physical activity, and you use Striped at your own risk.

  • Swing only in a safe, clear area. Check that no people, animals or property are within reach of your club or the ball, and follow the rules of your course, range or venue.
  • Your phone in your pocket. Striped is designed to be used with your iPhone in a pocket. Use a secure pocket that holds the phone firmly. A phone can fall out or be struck during a swing, and you carry the risk of damage to your devices. The same applies to your AirPods and Apple Watch.
  • Stay aware. Keep audio at a level that lets you hear what is going on around you. Never use Striped while driving or in any situation where your attention is needed elsewhere.
  • Not medical or fitness advice. Striped is a practice aid. It is not a medical device and does not provide medical, health, physiotherapy or fitness advice, and it is not a substitute for a qualified coach. Talk to a medical professional before starting a new training program if you have any health concerns. Stop if you feel pain or discomfort.

8. Accuracy of measurements

Striped estimates your swing from motion sensors worn on your body: your iPhone, AirPods and Apple Watch.

  • Its measurements are estimates. Striped is not a launch monitor or radar and does not measure ball flight, ball speed, club speed, club path, club face or any other club or ball data.
  • Striped may miss swings, detect swings that did not happen, or misjudge a measurement. Results depend on your devices, how they are worn and the conditions.
  • Where the App does not have enough support for a measurement, it may show an error range, label the figure as an estimate, or withhold it.
  • Measurements are for practice guidance only. We do not promise that using Striped will improve your game. Do not rely on Striped for any decision about your health or safety, or for any official or competitive purpose.

9. Your content and backups

You keep ownership of the recordings, video, audio, notes and other content you create with or add to Striped ("Your Content").

When you back up, sync or export Your Content, you grant us a limited, worldwide, royalty-free license to host, store, copy, process, transmit and display it to you. We use this license only to operate the Service for you, for example backup, restore, sync and export. It ends when Your Content is deleted from our servers as described in the Privacy Policy, apart from encrypted backup copies, which age out on their normal schedule.

You are responsible for Your Content. You must have the right to add any video or audio you include. If other people can be seen or heard in it, you must have their permission.

10. Striped Lab contributions

Striped Lab is available only in beta versions of the App. Sharing with Striped Lab is voluntary. A "Lab Contribution" is any session or material you share with Striped Lab, whether you share it from a session, send it from the Test Center, or have Auto-send to Striped Lab turned on.

For each Lab Contribution, you grant us a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, copy, store, analyze, modify and create derivative works from it, including de-identified versions. We may use these rights to:

  • research, develop, test, train, validate and improve Striped and its swing-analysis methods;
  • publish aggregate or de-identified findings that do not identify you.

We will not sell your Lab Contributions or use them for advertising. We will not publish your video, your audio, or anything else that identifies you without your permission.

  • If you delete your account: we keep an anonymized copy of each Lab Contribution you have not withdrawn, as described in the Privacy Policy. This license continues for that anonymized copy. You will no longer have access to it.
  • Withdrawing a contribution: while your account exists, you may withdraw a Lab Contribution by emailing us. We then stop using it for new work. Withdrawal does not undo findings, models or measurements we have already derived from it.

You are not paid for Lab Contributions. You confirm that a Lab Contribution is a genuine recording made as described, and that you have the right to share it.

11. Feedback

If you send us suggestions or feedback, we may use them without restriction or payment to you.

12. Beta versions

Beta versions of the App, distributed through TestFlight, are pre-release software. They may contain errors, change without notice or stop working, and Apple's TestFlight terms also apply to them. Features available in a beta version, including Striped Lab and the Test Center, may not appear in the App Store version.

13. Acceptable use

You agree not to:

  • copy, modify, distribute, sell or rent the App, or reverse engineer, decompile or disassemble it, except to the extent the law allows despite this restriction;
  • bypass or interfere with security features, including App Attest and account protections, or access another person's account or data;
  • overload, disrupt or probe our servers, or access the Service by automated means other than the App itself;
  • upload malware, or content that is unlawful, infringing, or recorded without the consent of the people in it;
  • knowingly submit fabricated or manipulated data to Striped Lab;
  • use the Service in any way that breaks the law or infringes other people's rights.

14. Our intellectual property

The App, the Striped swing engine, the website, and the Striped name and logo are owned by Mongo Technologies LLC and protected by law. Apart from the license in Section 5, these Terms give you no rights in them. iPhone, Apple Watch, AirPods, Sign in with Apple and App Store are trademarks of Apple Inc.

15. Third-party services and devices

Striped relies on services and hardware from third parties, especially Apple: Sign in with Apple, the App Store, HealthKit, iOS, watchOS, and AirPods and Apple Watch. Their terms apply to your use of them, and we are not responsible for them. Changes by those providers may affect how Striped works.

16. Availability, changes and support

  • Signing in, backup, sync and Striped Lab need an internet connection. Once you are signed in, recording works offline.
  • We may add, change or remove features.
  • We aim to keep the Service available but do not guarantee it will be uninterrupted or error-free.
  • If we decide to discontinue the online Service, we will try to give at least 30 days' notice in the App and a chance to export your data.
  • Support is provided by email at support@stripedgolfapp.com.

17. Termination

You may stop using Striped at any time and delete your account in the App. We may suspend or end your access to the Service if:

  • you materially or repeatedly breach these Terms;
  • the law requires us to; or
  • it is necessary to protect the Service, other users or us.

Where it is reasonable, we will give you notice and a chance to export your data first. When your access ends, the license in Section 5 ends. Your data is then handled as described in the Privacy Policy, and any subscription remains subject to Apple's terms (Section 4). Sections 9 to 11, 13, 14 and 18 to 24 survive termination.

18. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available." We disclaim all warranties, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. Some jurisdictions do not allow certain warranties to be excluded. If you are a consumer, nothing in these Terms affects rights you have by law that cannot be waived or limited by contract.

19. Limitation of liability

To the fullest extent permitted by law:

  • Mongo Technologies LLC is not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, data or goodwill, arising out of or relating to the Service or these Terms; and
  • our total liability for all claims relating to the Service or these Terms is limited to the greater of (a) the amount you paid for Striped in the 12 months before the event that gave rise to the claim, and (b) US$50.

Nothing in these Terms limits or excludes liability for:

  • death or personal injury caused by our negligence;
  • fraud;
  • gross negligence or willful misconduct;
  • anything else that cannot be limited or excluded by law.

20. Indemnity

To the extent permitted by law, you agree to indemnify Mongo Technologies LLC against third-party claims, and the reasonable costs of those claims, that arise from Your Content or Lab Contributions, or from your breach of these Terms or of the law. This does not apply to the extent a claim is caused by our own breach or negligence.

21. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-laws rules.

Before bringing a claim, please contact us at support@stripedgolfapp.com so we can try to resolve it informally. If we cannot resolve a dispute within 30 days, either of us may bring it in the state or federal courts located in Wyoming, and both of us consent to their jurisdiction. These Terms contain no arbitration requirement and no class-action waiver.

You may also bring a claim in the small-claims court where you live, if it qualifies. If you are a consumer living outside the United States, you keep the protection of the mandatory laws of your country of residence, and you may bring proceedings in your home courts where those laws allow.

22. Changes to these Terms

We may update these Terms, and we will change the "Last updated" date when we do. If a change is material, we will give you notice in the App or by email at least 30 days before it takes effect. A change needed for legal or security reasons may take effect sooner. If you continue to use the Service after a change takes effect, you accept the updated Terms. If you do not agree, stop using the Service and, if you wish, delete your account. Changes do not apply to disputes that arose before they took effect.

23. General

These Terms, together with the Privacy Policy and any terms the App shows you at the time of purchase, are the entire agreement between you and us about the Service.

  • If any provision is found unenforceable, the rest of these Terms remain in effect.
  • If we do not enforce a provision, we have not waived it.
  • You may not transfer your rights under these Terms. We may transfer ours as part of a merger, acquisition or sale of assets, with notice to you.
  • Neither party is responsible for delays or failures caused by events beyond its reasonable control.
  • Headings are for convenience only. If these Terms are translated, the English version controls to the extent the law permits.
